Palm Beach Gardens, Hides Public Records

Postby Records Seeker » Sun Mar 13, 2016 8:35 pm

The City Attorney, of Palm Beach Gardens, Max Lohman, uses an Officer of the Court,(Useful Idiot), to place a trespass on a private citizen, who was requesting public records.

This was, of course, a scheme to evade the requirements of Florida Public Records Law and to refuse to provide the records as requested. They had effectively erected a false accusation, as a barrier, however false the premise for the charges. To put it bluntly, City Attorney Max Lohman, refused to provide the records.

Emails that might exist, between officers, that would be readily identifiable for removal from the search results I’ve requested. However, such an obvious, simple solution would not further their elaborate charade to refuse delivery of public records.

Major Rogers, and Barca, refused an Internal Affairs Investigation, and are in the process, of fabricating false charges, as orchestrated by the city attorney, and an Officer of the Court.

Be careful Palm Beach Gardens public. The city leaders, are incompetent thugs.
And yet, they body cam good cops, when they should body cam, their city attorney.

This convoluted, wasteful exercise to avoid releasing public records from a city attorney is one more example of the questionable government practiced in Palm Beach Gardens these days.
It is no less than a violation of the Florida Public Records Act.
But now, with the collisions between a city attorney, and the officer of the court, establishes, that it could be far more serious than that.

This incident puts a spotlight on the City Attorney and his staff:
"We have a private domain operating within City Hall, actively working to evade scrutiny as well as responsibility to the public."

How many laws are being circumvented? What rights are being trampled? What shady deals are going on? Without access to our public records, we can’t know
He has failed to respond to multiple inquiries on this request. Public records distribution is a function of his office.

Where's The Public Integrity Unit, of the Palm Beach States Attorney's Office?

Public, and PBG Road Officers. Record your bosses, while on public property.

Management needs the body cams.
Road Officers, record your Sargent's, Sargent's, record your Major's. Major's record your chief.

Every one should record the city attorney, and Officers of the Courts, who help the city attorney, hide the evident corruption.

Dept. of Agriculture & Consumer Servs. v. Edwards, 654 So. 2d 628, 632-33 (Fla. 1st DCA 1995) wrote:
The expectation of privacy standard also takes into account other surrounding circumstances of the conversation. This includes the number of people present at a particular conversation, whether the setting of the conversation is in some sense public, and the nature of the discussion.

One Florida appellate court has held that it did not violate the Florida wiretap act for a subordinate law enforcement officer to record his supervisors' statements in a disciplinary interview; the court held that there was no reasonable expectation of privacy because of the number of persons present (five, the subordinate and four senior officers), the location of the interview (in a sergeant's office at a police station), and the nature of the interview (a disciplinary matter).

Smith v. City of Cumming, 212 F.3d 1332, 1333 (11th Cir. 2000) wrote:
The U.S. Court of Appeals for the Eleventh Circuit, the federal appellate court with jurisdiction over Florida, held in Smith v. City of Cumming, 212 F.3d 1332, 1333 (11th Cir. 2000), that "[t]he First Amendment protects the right to gather information about what public officials do on public property, and specifically, a right to record matters of public interest."

This First Amendment right to record the statements and activities of public officials has recently been amplified by rulings in other federal circuits.

ACLU v. Alvarez, 679 F.3d 583, 595 (7th Cir. 2012) wrote:
"The act of making an audio or audiovisual recording is necessarily included within the First Amendment's guarantee of speech and press rights as a corollary of the right to disseminate the resulting recording."

Glik v. Cunniffe, 655 F.3d 78, 85 (1st Cir. 2011) wrote:
"A citizen's right to film government officials, including law enforcement officers, is a basic, vital, and well-established liberty safeguarded by the First Amendment."

Another concern arises: If the City’s Information Systems Services (computer services), clerk, and records supt., is duped into cooperating with this secrecy, there does exist the possibility that crucial public records could be disappearing, with no trace.

We need immediate backups for long-term storage outside the city system with no possibility of erasure.
The public needs a good, hard look into our City Attorney’s Office. This kind of evasive action doesn’t occur without reason.

Maybe its more cost effective, for the city to comply with "basic requests?

GREENACRES — The city’s normally mild-mannered council meeting turned into something that resembled, well, a Warren Commission meeting during a pointed discussion Monday night over the $29,900 settlement offer in the public request lawsuit filed by Edward Joel Chandler.

The offer, negotiated in a closed door session earlier this month, was listed on the “consent agenda,” meaning a council member would have to pull the item off that list in order to discuss it before voting.

And, for the next 15 minutes, or so, Pearce, who is often at odds with his fellow council members, grilled City Attorney Pamela Terranova and City Manager Wadie Atallah over why the city didn’t settle sooner — and for less money — and who will be held accountable for the taxpayers footing a nearly $30,000 legal fees bill.

Major Rogers, is a fraud... Lies about public records, and refuses to produce.
Major Roger's not only has a badge, but he over-sees, and sets the example for others.

Which means, the Public, is in Major Danger, through the policies, of Major Roger.

You call that an investigation? Who got an IA reviews? Who was IA in that under-structured department?
Who checks the stupid factors?

You have a serious lack of knowledge. The Criminal Investigation resulted in Criminal Charges being filed. The phone calls by both Raja and Jones were a part of that. IA does NOT bring criminal charges because any interview done by them is a compelled statement and covered under Garrity. If you were a cop you would know that.

My goodness! You are obtuse aren't you? Raja is a guy who should have stayed in Atlantis. It is sad and actionable that he took Corey Jones's life and he will be held accountable for his actions. There absolutely was an IA Investigation and his employment terminated. He was charged criminally. If you had a brain, it would sue you for non support.

6. ARE YOU GOING TO LET YOUR MEMBERS SEE THE LETTER LIPPMAN WROTE THAT YOU FIRED HIM FOR?

LAST CALL FOR PBA MEETING (yesterday)

Postby IA Retired » Thu Sep 22, 2016 2:15 pm

I'm guessing the meeting was called to order while PBA Representatives were swallowing their last pieces of pizza, Kaz made some comments about recent shootings, what's going on in Charlotte, NC, and how important it is for officers to be represented by union lawyers. I'm guessing nobody said anything about him firing Gary Lippman who had the most experience of any union lawyer maybe in all of Florida (including the only in-house PBA lawyer that went into a Grand Jury with a white officer that shot and killed a young unarmed black male). Old business?

I'm guessing the PBA Treasurer gave a report on all the money still in PBA bank accounts and charity money, and nobody said anything about how much money Kaz has been spending on the PBA credit card or how much of the charity money he's been using to pay for him and his family's travel, hotel rooms, food, drink, and entertainment. I'm sure nobody asked him any of those questions that were posted up here, like whether he's going to stay on as president after his DROP is done in a couple weeks, whether he wrote himself a big PBA salary raise, whether he wrote himself a new PBA car, whether that 7 series BMW was paid for with PBA money, and if he's used his PBA credit card to pay for 1000s of dollars in golf clubs and equipment from a Kazanjian business up in Massachusetts.

I'm guessing the meeting went less then a hour and that a good time was had by all. EXCEPT the PBA members paying for everything (including the pizza and the drinks at the bar in the back)!
